Notes
The marriage contract with Jacques Barbot was inserted into the Prévôté de Québec’s records in December 1687 by a notary. According to this insertion, among the witnesses present at this contract were her sons from her first and second marriages, among others. (document viewable at source) Marriage between Jacques Barbot (Barbeau), working and living in the coast and seigneurie of Beaupré, and Jeanne Garnier, widow in first marriage of the late René Maheux, in second of the late Louis de Lamarre, and in third of the late Pierre Gendreau called LaPoussière. Present were sieur Jean Mathieu, master Jacques Goulet, Robert de LaBerge, François Blouin, the son of the late Maheux and of said Garnier, Pierre and Louis de Lamarre, sons of said Garnier and of her second husband, Jacques Goulet, René Goulet, master Nicolas Roussin, Charles LeLentre? (or Charles Esnou/Énard?), relatives and friends of the future spouses. – October 22, 1679 [Document inserted on December 16, 1687][23]
In 1684, Jeanne Garnier was ordered to assemble friends and family of her minor children before the Beaupré judge to give their advice regarding the sale of a certain piece of land, originally brought to their marriage by René Maheu. She wished to retire from the country to the city with her husband (Jacques Barbault), as she was getting old. The main other party who had interest in this land was her minor grandson René Maheu (3rd of the name), whose mother Barbe Boucher was a widow. Decree ordering that Jeanne Garnier, now wife of Jacques Barbault and previously widow of René Maheu, assemble the relatives and friends of the minors before the judge of Beaupré, to give their opinion on the sale of a certain land. – March 20, 1684 Content scope: Transcription of the text with modernized spelling: “Having seen the petition presented to this Court by Jeanne Garnier, now wife of Jacques Barbault authorized by him, previously widow of René Maheu. Containing that by the marriage contract between said René Maheu and her, passed before Guillaume Audouart, then notary in this city on July 22, 1657. Said Maheu had brought into the community contracted between them a land and habitation belonging to him on the coast of Beaupré by contract passed before the same notary on September 3, 1656, on which land there were only four arpents cleared and plowed once with a hoe at the time of his death, as it appears by inventory, the remainder of the state in which it is presently having been cleared by the petitioner during her widowhood, and subsequently by the late Pierre Gendreau during his marriage with the said petitioner, who wishing to retire from the countryside to establish herself in this city, and for this purpose to build on a plot that said Barbault has acquired in the lower town and on which he is in the process of erecting a house frame. And to be able to have it built, wanting to sell her half of said land, it would have been divided and partitioned with Barbe Boucher, widow of René Maheu, son of said late René Maheu and the petitioner by Jean Guyon Dubuisson, sworn surveyor according to his minutes of May 4 last, because of a posthumous child she remained pregnant with after the death of said late René Maheu her husband, and of which child she has since given birth, and who is also named René, said Barbe Boucher having been assisted because of her minority by Pierre Boucher her father, but the petitioner and her said husband having wanted to sell said half of land as said above, the people who had presented themselves to acquire it having taken some Counsel fearing to be troubled in the property and possession of this half of habitation by said child and by the other children of the other marriages of the petitioner because the custom is rather rigid to second and other subsequent marriages to with much prudence and justice prevent those who thus remarry from making advantages that prejudice the children of their previous marriages, which the petitioner also has no intention of doing but only tries in her old age to withdraw from the pains and labors of the countryside by establishing herself in the city where her husband hopes to work at the trade he professes to live there with more rest and sweetness and who is even ready to affect and mortgage said house to stand in place in the future for the petitioner and her children after his death up to the amount of what will come to her from the money of the price of said land, this considered and seen the pieces above stated and dated by which it appears that the petitioner is owner of said half of land and that she should enjoy half of the other half for her dower, she begs this Court to order that she may on the authority of her said husband dispose by sale of said half of habitation for such price and to such person as she shall deem appropriate, to the offers that said Barbault will make to replace it on said house, and not to touch the money except in proportion as it will be built to help him build it, both for the security of the buyer and of the petitioner and of said children, as well as that she will enjoy for her dower half of the other half that belongs in said land to said Barbe Boucher because of her said child, said petition signed Jacques Barbot, seen said pieces. It has been said, before making right, that assembly of parents and friends of said minors neighbors of said land will be made before the judge of Beaupré in the presence of the prosecutor of the jurisdiction of said place, to give their opinions on the exposition in said petition, the result of which assembly will be recorded by said judge, which reported, and all communicated to the attorney general, together with said pieces and the inventory to be then made right. DEMEULLE.”[24]
